The terms and conditions that govern your use of this website.

1. General

1.1 Ella Millett Legal Ltd (the “Firm”) is a Limited Company registered in England and Wales with company number 11595082. The Firm’s registered office is at 164 (A) Bramcote Lane, Wollaton, Nottingham, NG8 2QP.

2. Terms of Website Use

2.1 These terms and conditions (the “Terms”) set out below govern your use of this website, found at www.ellamillettlegal.co.uk (the “Website”).

2.2 References on the Website to “Ella Millett Legal Ltd”, “Ella Millett Legal Solicitors”, “the Firm”, “we”, “us” or “our” mean the owners of the Firm.

2.3 The legal information on the Website sets out the Terms upon which you use the Website, and makes accessible certain other legal and regulatory information which it is best practice to place in the public domain. For clients of the Firm, this should be read alongside our client care letter and terms of business (the “Client Care Documents”) and any documents referred to in them, such as a conditional fee agreement. The Client Care Documents take precedence over any legal notice on the Website where they differ.

2.4 The Website is owned and operated by the Firm, including any subsidiary undertakings, co-branded businesses and joint ventures which may exist from time to time.

2.5 Use of the Website is governed by the Terms, which were last reviewed in January 2021. The Firm reserves the right to make changes to any part of the Website or the Terms at its discretion, without notifying you; it is your responsibility to check the Terms each time you use the Website. Specific terms may also apply to particular services provided via the Website.

2.6 We reserve the right to alter, suspend or discontinue any part of the Website or the services provided through it, including your access to it. While we make every effort to ensure the Website’s content is correct, it may have become out of date, and we give no warranty regarding its fitness for purpose, availability, quality, accuracy or completeness. The materials on the Website do not give specific legal advice and should not be relied on as doing so — laws and regulations may differ outside England. Using the Website does not create a contractual or solicitor-client relationship between you and the Firm; we recommend contacting the advisers named on the Website for advice about particular matters. The Firm excludes all liability for any loss or damage that may result from use of, inability to use, or reliance on the Website.

2.7 You may read the Website’s contents and download and temporarily store them for your own personal or non-commercial use. Apart from content specifically made available for download, such as court forms and publications, you may not permanently copy, store or redistribute the Website’s contents. Where we make content available for download, this is for your personal use, or circulation within your business, and not for commercial re-use. You may not link to the Website from your own website without our prior written consent.

2.8 Any links to other websites are provided for convenience only; the Firm accepts no responsibility or liability for your use of, or reliance on, any linked website, and inclusion of a link does not imply endorsement.

3. Copyright and Intellectual Property

3.1 Copyright and other intellectual property rights in the Website’s content, including the Firm’s marks, logos and brands, belong to the Firm or its licensors. All rights not expressly granted are reserved. If you are unsure whether an item is protected, please contact us for clarification.

4. Disclaimers Relating to Downloads

4.1 The Website may allow users to download certain documents also available directly from other websites, such as court forms.

4.2 To the extent permitted by law, the Firm excludes all liability for any costs, losses, claims, damages, expenses or proceedings incurred or suffered by you arising from use of the download facility or its content, including from any defect, error, inaccuracy or unavailability.

4.3 Documents available for download are created exclusively by third parties; the Firm excludes all liability for any illegality arising from error, omission, inaccuracy or copyright in such material.

4.4 Downloads are provided solely for your convenience; the Firm does not necessarily endorse downloadable material and has no liability to you in respect of it.

4.5 Downloading documents should not be used as an alternative to legal advice from a qualified solicitor, and using such documents does not create a solicitor-client relationship with the Firm.

4.6 Material downloaded through the Website is done so at your own discretion and risk, and you are solely responsible for any resulting damage to your computer system or loss of data.

4.7 The Firm cannot guarantee downloads will be free from error or uninterrupted, and shall not be liable for any resulting damages.

4.8 While effort is taken to ensure downloads are free from viruses, no warranty is given, and users are responsible for having adequate virus-checking software. The Firm shall not be liable for any viruses or malicious code, and all documents are downloaded at the user’s own risk.

4.9 Nothing in the Terms excludes or limits liability for death or personal injury arising from negligence, or any liability that cannot lawfully be excluded.

5. Financial Services and Insurance Distribution

5.1 Marketing: Where the Website or our other materials refer to financial services provided by the Firm — such as arranging after-the-event legal expenses insurance or title indemnity insurance — this does not indicate that the Firm is exempt from the general prohibition on providing regulated financial services. The Firm is not authorised by the Financial Conduct Authority, nor exempt from authorisation under sections 38–39A of the Financial Services and Markets Act 2000.

5.2 Insurance distribution activity: The Firm is not authorised by the Financial Conduct Authority, but is included on its register so that we can carry on insurance distribution activity in the UK — broadly, advising on, selling and administering insurance contracts. This part of our business, including complaints or redress arrangements, is regulated by the Solicitors Regulation Authority.

5.3 Investment transactions: The Firm is not authorised under the Financial Services and Markets Act 2000, but may in certain circumstances offer a limited range of investment services as an incidental part of the professional services we’ve been engaged to provide, because we are regulated by the Solicitors Regulation Authority. Nothing we say or do should be construed as an invitation or inducement to engage in investment activities, or as advice on the merits of any investment.

6. Electronic Commerce (EC) Directive Regulations 2002 and Provision of Services Regulations 2009

6.1 The following information is provided to ensure our compliance with the above regulations:

6.1.1 The Firm is authorised and regulated by the Solicitors Regulation Authority (ID Number: 666527) and is bound by the SRA Standards and Regulations, viewable at sra.org.uk.

6.1.2 The Firm maintains qualifying Professional Indemnity Insurance, details of which are available on request.

6.1.3 The Firm operates an internal complaints procedure, available on request, and is committed to cooperating fully with the Legal Ombudsman — www.legalombudsman.org.uk.

7. Severability

If any part of the Terms is found illegal, invalid or unenforceable under the laws of any state or country in which they are intended to apply, that part shall be treated as severed and deleted, and the remaining provisions shall survive and remain in full force and effect.

8. Events Beyond Our Control

The Firm will not be responsible for any breach of the Terms caused by circumstances beyond its reasonable control.

9. Governing Law

This legal notice and all issues regarding the Website are governed by English law. Access is granted on condition that you accept the above and agree to the jurisdiction of the courts of England and Wales.

10. Reports of Misuse

We take feedback seriously and are always looking for ways to improve the Website. If you have any comments or concerns, or would like to report misuse of the Website, please email ella@ellamillettlegal.co.uk.

11. Email Policy

11.1 Views expressed in any email from the Firm are those of the author and are not necessarily endorsed by the Firm.

11.2 Information in any message or attachment is intended solely for the addressee, is confidential and may be legally privileged. If you receive a message in error, please return it to us and delete it immediately and permanently; unauthorised use, disclosure, copying or alteration is strictly prohibited.

11.3 It is your responsibility to scan messages and attachments for viruses. All outgoing email is scanned prior to leaving our network, but the Firm does not guarantee the security of any message and will not be responsible for damage arising from a virus or third-party alteration.

11.4 We may monitor emails sent to and from our network.
